Real Reasons Aisha Buhari Withdrew Suit Against The Embattled Student

Following criticism and condemnation from activists, Amnesty International, the National Association of Nigerian Students, and others, the First Lady, Aisha Buhari, has abandoned the case against Aminu Mohammed, a final-year student at the Federal University of Dutse.

The prosecution counsel, Fidelis Ogbobe, withdrawing the case on behalf of Mrs Buhari, told the PUNCH that Aisha Buhari, as the mother of the nation, chose to withdraw the case after the intervention of “well-meaning Nigerians.”

Ogbobe invoked section 108 subsection 2(a) of the Administration of Criminal Justice Act in his plea to discontinue the case.

The FCT High Court’s Justice Yusuf Halilu praised Aisha Buhari for abandoning the matter.

Halilu, while granting the release warrant, urged parents to always supervise their children in order to avoid recurrence.

According to a police report, Mr Muhammed was arrested on November 18, 2022, at Federal University Dutse, after Aisha Buhari sent a team of police investigators to locate him down.

According to the PUNCH, the Presidency had previously prohibited guests from visiting convicts at the Suleja Correctional Centre in Niger State following Aminu’s detention.

Punch source, who visited the institution as an undercover journalist on Thursday, noticed increased security presence and a note that reads “No Visitation” pasted at the entrance.

Following Aminu’s arrival at the prison, a security operator who attended to our correspondent remarked that the Presidency had issued an order prohibiting all types of visitation.

“We can’t let you into the facility,” he said anonymously. No one is permitted to see Aminu. In fact, no one has been allowed to visit detainees at the facility since he was brought in on Tuesday. You can read the letter on the wall, there is no visitation, and I don’t want to lose my work.”

The officer, on the other hand, stated that Aminu has been without food since he arrived at the facility on Tuesday, adding that he only had N2000 on him, which he had wasted, and could not afford to acquire food because no one was permitted to visit or call him.

“I feel for the boy, he came here with only N2000, and it’s finished,” he continued. He complained of hunger today, but we couldn’t help him because no one was allowed to visit or call him. This morning, he simply ate bread.”

Amnesty International Nigeria has also criticised Aminu Muhammed’s detention and alleged torture, stressing that the 500-level undergraduate of the Federal University, Dutse, Jigawa, must be released and the spurious allegations against him dropped.

Following accusations that he has been tortured and subjected to other ill-treatment, including severe beatings, during his detention, AI stated, “The Nigerian authorities must quickly release Aminu Muhammed and withdraw all charges against him.” He is a student accused of defaming Nigeria’s First Lady, Aisha Buhari, on Twitter.”

In apparent violation of international human rights law, he was then detained in an unknown place and refused access to his family and lawyer.

In response, Amnesty International’s Nigeria Director, Osai Ojigho, stated, “It is beyond reprehensible that Nigerian authorities have arrested and allegedly tortured Aminu Adamu Muhammed after he simply Tweeted about the First Lady of Nigeria.” This blatantly repressive act infringes his human rights.

“The fraudulent charges against Aminu must be dropped immediately and unconditionally.” Instead, the authorities should launch an investigation into his illegal imprisonment and brutal treatment. The fact that he was detained incommunicado demonstrates the Nigerian government’s widespread impunity.

“Aminu’s final exams at the Federal University Dutse are set for December 5, 2022.” He needs to be released as soon as possible so that he can finish his degree.”

Aminu was charged with Cybercrime, Cybersquatting, Computer Related Forgery, Conspiracy, and Criminal Breach of Trust on November 29, 2022.

Amnesty International stated that despite President Muhammadu Buhari ratifying the Anti-Torture Act in 2017, torture and other ill-treatment continue to be prevalent in Nigeria, with police and state security agents continuing to subject detainees to torture and other cruel, inhumane, or degrading treatment.

“The heavy-handed maltreatment of Aminu is a blatant attempt to strike fear into the minds of young Nigerians who use social media to hold the powerful accountable,” Ojigho continued. Nigerian authorities must immediately recognise and protect the right to free expression.

“Amnesty International is concerned about the growing number of attacks in Nigeria on freedom of expression.” Authorities are increasingly employing illegal arrests and ill-treatment to silence critics of the state. This has to end right now.”
