FBI and DEA Ordered to Release Tinubu Drug Investigation Records by US Court

In a landmark ruling that has reignited public discourse, FBI and DEA have been ordered by the United States District Court for the District of Columbia to release Nigeria’s current President Bola Tinubu’s drug investigation records. The Federal Bureau of Investigation (FBI) and the Drug Enforcement Administration (DEA) are to release non-exempt documents related to the criminal investigation of President Bola Tinubu over alleged drug trafficking activities in the 1990s.

The decision, issued on April 8, 2025, by Judge Beryl Howell, follows a legal battle initiated by American transparency advocate and researcher Aaron Greenspan, who filed Freedom of Information Act (FOIA) requests between 2022 and 2023. Greenspan had sought records concerning a Chicago-based drug cartel and individuals linked to it—including President Bola Tinubu, Lee Andrew Edwards, Mueez Abegboyega Akande, and Abiodun Agbele.

Court Rejects FBI and DEA Secrecy Claims
The FBI and DEA had previously denied the existence of relevant documents through what is known as a “Glomar response,” a strategy used by U.S. intelligence agencies to neither confirm nor deny the existence of requested records. However, the judge ruled that the agencies had failed to justify continued secrecy under FOIA regulations.
“Any privacy interests implicated by the FOIA requests to the FBI and DEA for records about Tinubu are overcome by the public interest in the release of such information,” the ruling stated.
Judge Howell emphasized that both the FBI and DEA have officially confirmed criminal investigations involving Tinubu in the past, negating their claims to protect privacy or national security.
CIA Exempted, But FBI and DEA Must Comply
While the court upheld the CIA’s Glomar response, the same legal courtesy was not extended to the FBI and DEA. The court granted summary judgment in favor of the plaintiff, declaring the previous secrecy as unjustified.
“The FBI and DEA must search for and process non-exempt records responsive to the FOIA requests directed to these agencies,” the judgment ordered.
A joint report on the status of the outstanding issues has been requested by May 2, 2025.

The ruling has sparked wide-ranging reactions in both political and public circles. The Presidency dismissed the court order, stating that “nothing new will be revealed,” while maintaining that related information has been available in the public domain for over 30 years.
Meanwhile, political commentator Daniel Bwala labeled the development as “political nonsense,” suggesting it was an attempt to distract from domestic governance matters.
Legal experts, however, say the ruling sets a significant precedent in international transparency and could embolden future FOIA requests concerning public figures worldwide.

The allegations stem from the early 1990s, when Tinubu, then a young professional in Chicago, was reportedly linked to financial transactions associated with a drug trafficking ring. In 1993, a U.S. court ordered the forfeiture of over $460,000 from bank accounts allegedly connected to the illicit operation. Though never criminally charged, the forfeiture has remained a controversial topic in Nigerian politics.
