The Peoples Democratic Party (PDP) lawsuit asking that the candidates for governor and the National Assembly from the Labour Party and Young Progressives Party be disqualified from running in the general elections of 2023 has been dismissed by the Federal High Court in Abuja.
Due to a lack of thorough prosecution, the court dismissed the lawsuit on Monday.
The PDP asked the court to order that the names of the two parties’ candidates that had been published be thrown out in the lawsuit with the file number FHC/ABJ/CS/1899/2022.
The party additionally requested a court injunction directing the Independent National Electoral Commission to remove the candidates’ names from the published list.
The PDP also requested a second order declaring the claimed primaries’ result sheets unlawful on the grounds that they were illegal, untrue, and of no use at all.
Prior to submitting the names of its candidates to the electoral umpire, the party claimed that LP and YPP failed to hold primary elections.
PDP asserted, among other things, that the two parties did not provide the obligatory 21-day notice to the electoral commission as required by law before conducting their respective supposed selection processes.
The PDP called for the complete disqualification of its candidates for governor and the National Assembly through its legal counsel, Egwuaba Reuben.

PDP requested that the court issue a declaration that the two parties never held primary elections on any day to choose or nominate candidates whose names were purportedly published by INEC to run in the 2023 elections. PDP specifically claimed that the LP and YPP violated sections 29, 82, and 84 of the Electoral Act 2022 in their respective primary elections that produced the candidates for the general elections in 2023.
However, neither the PDP nor its attorney was present in court on Monday’s hearings, and there was no reason for their absence.
Justice Inyang Edem Ekwo agreed that PDP had not handled the lawsuit diligently after receiving a request to dismiss it. As a result, the judge dismissed the case and ordered the parties to bear the costs of litigation.
