Sen. Emmanuel Bwacha, who represents Taraba South in the Senate and was elected in 2019 under the auspices of the Peoples Democratic Party (PDP), has been dismissed by the Federal High Court in Taraba State’s capital city of Jalingo.
After the former deputy senate minority leader switched to the APC in February, the Peoples Democratic Party went before the court to assert their party’s mandate.
Bwacha was ordered to leave the seat immediately by Justice Simon Amobeda, who made the decision on Thursday in a case with the filing number FHC/JAL/CS/9/2022.
He determined that the first defendant, Emmanuel Bwacha, had violated the law by switching sides during the tenure of the senate to which he had been elected in the 2019 general election, from the plaintiff People Democratic Party (PDP), to the second defendant (APC) party
The judge used section 68(1) (g) of the Federal Republic of Nigeria’s constitution in his ruling, concluding that the plaintiff had made a strong case and was therefore entitled to the reliefs requested.

The first defendant’s seat in the Senate of the National Assembly of the Federal Republic of Nigeria shall be promptly declared vacant by the fourth defendant (the Senate President), according to the judgement.
