Why Tinubu’s Presidential Candidacy Is Illegal – PDP

The Peoples Democratic Party, PDP, has declared Asiwaju Bola Tinubu’s presidential candidacy of the ruling All Progressives Congress, APC, illegitimate and null and invalid, quoting the 2022 Electoral Act,

Debo Ologunagba, the PDP’s National Publicity Secretary, made this claim at a news conference in Abuja on Saturday.

Ologunagba emphasised that the recent court ruling that invalidated the APC’s candidate in the just concluded Osun State governorship election, Adgeboyega Oyetola, might be used to Tinubu’s nomination.

He stated that the role of the APC Caretaker Committee, Mai Mala Buni, who also served as the state governor of Zamfara State, was unconstitutional under Section 183 of the Electoral Act.

“Mai Mala Bala was supposed to be the Chairman of the APC, and the laws stipulate that an executive governor cannot double as Chairman.” As a result, the court has declared Oyetola’s candidacy for Governor of Osun State null and void.

“The same Mai Mala Buni was the caretaker chairman who sponsored Tinubu’s nomination.” We are stating that if the procedure that sponsored the nomination of the APC’s presidential candidate was unconstitutional, then Bola Tinubu’s nomination is illegal, null and invalid.”

When asked if the PDP will proceed to a court of competent jurisdiction to establish his claim, he stated that the party had already counselled the APC on the topic and had studied the recent Oyetola case.

“The PDP would not disclose whether we are going to court,” Ologunagba stated. You’ll be notified if we need to go to court.”
